Stocktaking, Reforms, and the Road Ahead

OVERVIEW

Over the years, the NUJS Law Review has provided legal analysis and commentary on a range of issues and, in doing so, has invited academics, policymakers, law students, practitioners, and those interested in legal studies. Articles from the journal have been cited by judges of the Supreme Court of India, the Ministry of Finance, the Law Commission of India, and various lawyers on multiple occasions. The Law Review has contributed to the development of jurisprudence, specifically on disability rights, election law and subaltern epistemologies.

With this special issue, we invite submissions focusing on the Insolvency and Bankruptcy Code, 2016 of India. The IBC has been responsible for overturning the regime for exit of corporate entities in the business structure. It has adopted from international counterparts to create an efficient regime that focuses on debt resolution as the key objective while balancing the interests of stakeholders in mind. The recent amendments to the Code this year also provide grounds for sufficient discourse from the legal fraternity that our journal wishes to expand upon.

This issue proposes to interact with key concerns surrounding the state of insolvency laws in India, including but not limited to comparative pieces provided there is a substantial focus on Indian law. Submissions may address the state of insolvency law in any manner, including but not limited to the status quo and the way ahead to reflect the journey of IBC in the last 10 years.
